Recording someone else’s composition creates a new sound recording, but the underlying song still belongs to its copyright owners. U.S. compulsory mechanical rules can apply to certain uses under specified conditions.
Why the distinction matters
The Copyright Office distinguishes digital phonorecord delivery rules from other distribution methods. A mechanical license does not automatically authorize synchronization in video or copying another artist’s master recording. Significant alterations to the original composition may require separate permission.
Checklist for creators
Before releasing a cover, identify the original work and rights holders, choose the correct licensing process for the medium and territory, and retain evidence of payments and permissions. Do not rely on a generic ‘cover song approved’ label for every downstream use.
